Danielle Gauthier now acts as an “impartial third party” in the roles of mediator and accredited investigator in matters of psychological harassment, sexual harassment and discrimination in the workplace. She also offers her services to sports organization to investigate denunciations and complaints of abuses or maltreatment.
She is fully bilingual.
She applies to her work the best practices developed by the Québec Bar, ensures the absence of conflicts of interest and offers the required availability to act as soon as possible in an approach that respects the standards of fairness and independence of the profession.
For organizations or employers under Federal jurisdiction, she applies, when required, the Investigation Guide on the Policy on Harassment Prevention and Resolution and Directive on the Harassment Complaint Process.
Psychological harassment, sexual harassment and discrimination investigation.
– Study of admissibility of denunciations and complaints ;
– Recommendations for the application of interim measures, if required;
– Investigation, meeting with parties involved and witnesses;
– Collect and analyze evidence;
– Provide written reports and conclusions based on the evidence gathered,
applicable policy and current case law ;
– Recommendations for administrative or disciplinary measures, if required;
Mediation
– Mediation in Civil and Employment law;
– Labour disputes, between employees or between employees and managers;
– Grievances regarding the interpretation and application of collective agreement provisions;
– To support employers and employees in setting up conditions for employees returning to work following long disability, or after conflict resolution;
– Pursuant to the filing of a complaint when the complainant and respondent consent instead of the investigation.
Investigation of Abuse and maltreatment in Sports
For mandates regarding sports organizations, she refers to the Code of Ethics, the policies and procedures applicable and works as an independent and impartial third party with respect to all the parties involved in order to provide a fair and equitable process of inquiry.
